Your use of the Website does not create a customer, consultant, fiduciary, professional, or managed-services relationship with Orinoco 360.

You may not:
- Use the Website in violation of any applicable law or regulation;

We may restrict or terminate access when we reasonably believe these Terms have been violated or the Website, Orinoco 360, our customers, or others may be at risk.
3. Informational Content and Technology Guidance
Technology, cybersecurity, software, licensing, cloud services, vendor requirements, and industry practices change frequently. Website information may become incomplete or outdated and may not apply to your particular environment.
Blog posts, tutorials, troubleshooting instructions, security recommendations, examples, downloads, and other Website materials are provided as general information. You are responsible for evaluating whether any instruction is appropriate for your systems and for maintaining current backups before making changes.
Do not make material changes to production systems, security controls, networks, cloud environments, or business applications solely in reliance on general Website content.
4. No Guarantee of Services or Results
Descriptions of services, capabilities, savings, project outcomes, security improvements, response times, or other potential benefits are illustrative and do not constitute a guarantee.
Actual results depend on factors including the customer’s systems, budget, licensing, personnel, configuration, cooperation, third-party providers, threat environment, and compliance requirements.
Specific services, responsibilities, service levels, pricing, warranties, and deliverables are governed only by the applicable written agreement between Orinoco 360 and the customer.
5. Cybersecurity Disclaimer
No cybersecurity product, service, configuration, assessment, monitoring system, backup platform, or professional recommendation can eliminate every risk or guarantee that an organization will not experience a cyberattack, data loss, service interruption, unauthorized access, or other security incident.
Website content should not be interpreted as a warranty that any particular technology, product, process, or service will prevent all security incidents.
6. Artificial Intelligence and Automated Content
We may use artificial-intelligence and automation tools to assist with research, analysis, drafting, service delivery, workflow improvement, customer communications, or Website content.
AI-assisted output may contain errors, omissions, outdated information, or unexpected results. Materials involving AI or automation should be reviewed by a qualified person before being relied upon for operational, legal, financial, medical, compliance, employment, or security decisions.
Unless specifically stated in a written agreement, Website content does not constitute a representation that an AI-generated or AI-assisted result is accurate, complete, unique, or suitable for a particular purpose.
7. Intellectual Property
The Website and its content—including text, graphics, logos, branding, page designs, videos, images, software, downloads, documentation, and other materials—are owned by or licensed to Orinoco 360 and are protected by intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for legitimate personal or internal business purposes.
You may not reproduce, republish, distribute, modify, sell, license, publicly display, or create derivative works from Website content without prior written permission, except for limited quotations or uses permitted by law with appropriate attribution.
“Orinoco 360,” associated logos, and related branding may not be used in a manner that suggests endorsement, sponsorship, or affiliation without written authorization.
8. User Submissions
When you send us an inquiry, feedback, suggestion, testimonial, file, or other communication, you represent that:
- You have the right to submit it;
- Its submission does not violate another person’s rights;
- It does not contain unlawful, malicious, or misleading material; and
- You will not submit passwords, access keys, financial-account information, protected health information, or unnecessary sensitive information through a general contact form.
You retain ownership of content you submit. You grant Orinoco 360 permission to use the submission as reasonably necessary to respond to you, evaluate your request, operate our business, protect our rights, and provide requested services.
We will not publicly use your name, logo, testimonial, or identifiable customer information for marketing without authorization where authorization is required.
9. Third-Party Services and Portals
The Website may link to third-party services, including the Zoho Books customer portal, Atera support portal, vendor portals, social-media platforms, software-provider websites, and other external resources.
Third-party services are operated independently and may have their own terms, privacy policies, security practices, fees, and availability requirements. Orinoco 360 does not control and is not responsible for third-party content, systems, policies, or performance.
A link does not necessarily constitute an endorsement or warranty.
Your access to a third-party portal may also be governed by a customer agreement or by credentials issued under a separate service relationship.
10. Privacy
Our collection and use of personal information through the Website are described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Electronic Communications
When you submit a form, email us, subscribe to communications, or otherwise contact us electronically, you consent to receive responsive communications electronically.
You are responsible for maintaining accurate contact information and for using reasonable security precautions when transmitting information.
Marketing communications may be discontinued through the unsubscribe mechanism included in the message or by contacting us.
12. Website Availability
We may modify, suspend, restrict, or discontinue all or part of the Website at any time. We do not guarantee that the Website will always be available, uninterrupted, secure, current, or free from errors or harmful components.
Maintenance, security events, provider outages, network failures, attacks, or circumstances beyond our control may affect availability.
13. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
ORINOCO 360 DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
ORINOCO 360 DOES NOT WARRANT THAT THE WEBSITE OR ITS CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, COMPLETE, CURRENT, SECURE, OR SUITABLE FOR YOUR PARTICULAR NEEDS.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ORINOCO 360 AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE WEBSITE.
THIS INCLUDES LOSS OF DATA, REVENUE, PROFITS, BUSINESS OPPORTUNITY, GOODWILL, SYSTEM AVAILABILITY, OR BUSINESS INTERRUPTION, EVEN IF THE POSSIBILITY OF SUCH DAMAGES WAS KNOWN.
TO THE FULLEST EXTENT PERMITTED BY LAW, ORINOCO 360’S TOTAL LIABILITY ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
These limitations apply only to Website use and do not replace liability provisions contained in a separately signed customer agreement.
Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Orinoco 360 and its owners, officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses—including reasonable attorneys’ fees—arising from:
- Your unlawful or unauthorized use of the Website;
- Your violation of these Terms;
- Content or information you submit;
- Your infringement of another person’s rights; or
- Your malicious, fraudulent, or abusive conduct involving the Website.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless prohibited by applicable law or superseded by a separate written agreement, any legal action arising solely from the Website or these Terms must be brought in the state or federal courts located in [COUNTY] County, Florida, and each party consents to the jurisdiction of those courts.
17. Changes to These Terms
We may revise these Terms periodically. Updated Terms will be posted on this page with a revised “Last Updated” date.
Your continued use of the Website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
18. Severability
If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.
19. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
